RESEALING CANADIAN PROBATE IN THE UK

Canada is a country recognised under the Colonial Probate Act, which means that a Letters of Probate issued in Canada (the equivalent of a grant of probate issued in the UK) can be resealed in the UK. Once this is undertaken, UK assets can then be collected.
Documents we would require
We would typically require the following documentation :-
- • Original or cerified ( by a Notary Public/Solicitor ) Death Certificate
- • Original Grant of probate or Letters of Administration issued by the High Court in Canada, together with the Will, this must be sealed ( eg.carry the stamp ) by the High Court
- • Confirmation of the UK assets to be collected eg. UK bank account details, share documentation etc.
- • Identification of the Executor or Administrator of the Estate to comply with UK ML Rules - identification must be certified by a Notary Public
